01 · Agreement and eligibility
Your agreement with PayCal
PayCal is a trading name of MyMedicalSupport UK Ltd. These Terms of Service (Terms) form a legal agreement between MyMedicalSupport UK Ltd trading as PayCal (PayCal, we, us or our) and the person or organisation using the PayCal mobile application, paycal.co.uk, or a PayCal booking, payment, invoice, form, cancellation or rescheduling page (together, the Service).
By creating an account, accepting these Terms in the app, or using the Service, you agree to these Terms and our Privacy Policy. If you use PayCal for a company, partnership, sole-trader business or other organisation, you confirm that you have authority to bind it. In that case, you includes that organisation.
Business accounts are intended for people aged 18 or over. You must be legally capable of entering into this agreement and must use the Service for a genuine, lawful business. You may not create an account if we have previously suspended you for a serious or repeated breach unless we agree otherwise in writing.
Business users and customer users
A Business User is a business owner, staff member or authorised person who manages a business through PayCal. A Customer User is a person who uses a PayCal page to book, pay or interact with a Business User. Some provisions apply only to Business Users and are marked accordingly.
When a Customer User books or buys a service, the contract for that service is directly between the Customer User and the Business User. PayCal is not the supplier of the booked service and is not responsible for performing it.
02 · Accounts and access
Keeping your account accurate and secure
- Accurate information. You must provide current, complete and accurate account and business information and keep it updated.
- Security. Keep credentials, devices, one-time codes and recovery details secure. Do not share a personal login. Use staff accounts and permissions where available.
- Authorised users. The account owner controls staff access and is responsible for activity carried out by authorised users, including their permissions and removal when access is no longer needed.
- Security incidents. Tell us promptly at [email protected] if you suspect unauthorised access, compromised credentials or misuse.
- One business, one accountable owner. The account owner must have authority over the business. Ownership disputes may require evidence before we change control or access.
We may require identity, business or payment verification, either directly or through Stripe, Apple, Google or another provider. You authorise us to rely on information those providers return for account security and entitlement purposes.
Service changes and availability
We develop PayCal continuously and may add, improve, replace or retire features. We will give reasonable notice where a change materially reduces a paid core feature, unless an urgent security, legal or third-party requirement makes advance notice impracticable. We aim to keep the Service available, but maintenance, connectivity, app-store, payment-provider and other interruptions can occur.
03 · Plans, fees and billing
Free and paid PayCal plans
PayCal may offer Free, Pro, Unlimited or other plans. The features, limits, subscription price, billing period and any PayCal platform fee shown in the app or on our pricing page when you subscribe form part of these Terms. Prices may include or exclude VAT depending on what is displayed and the applicable tax rules.
Free plan
No recurring PayCal subscription charge. Feature, business and staff limits may apply, and a disclosed platform fee may apply to supported customer payments.
Paid plans
Paid plans unlock the features and limits shown at purchase. A lower platform fee or no PayCal platform fee may apply depending on the selected plan.
SMS and optional extras
SMS packages, communication credits or optional services may be sold separately. Their price, allowance and expiry—if any—will be shown before purchase.
Provider charges
Stripe processing charges, app-store charges, mobile-network costs and taxes are separate from PayCal fees unless expressly stated otherwise.
App-store subscriptions
Paid PayCal subscriptions purchased through Apple or Google are billed by the relevant app store and normally renew automatically for the period shown at purchase until cancelled. The store displays the price and renewal period before confirmation. Manage, cancel, upgrade, downgrade, restore or request an eligible refund through the store account used to purchase the subscription. Deleting the PayCal app or closing a business workspace does not itself cancel an app-store subscription.
A cancellation stops future renewals but normally leaves paid access active until the end of the current billing period. Upgrades or downgrades take effect according to the relevant store's rules. App-store billing, refunds, price-change notices and payment failures are also governed by that store's terms.
Price and plan changes
We may change future prices, plan limits or platform fees. We will display or notify material changes before they take effect. App-store subscription price changes are also subject to the store's notification and consent process. If you do not agree to a material change, you may cancel before the next renewal or stop using the affected paid feature.
Taxes, failed payment and refunds
You are responsible for applicable taxes arising from your use of PayCal, except taxes on PayCal's own income. If subscription payment fails or an entitlement expires, paid features may be restricted and the account may move to the available free plan. Except where the purchase screen, app-store rules or law provide otherwise, fees already charged for a completed billing period are not refundable merely because the Service was unused.
04 · Payments and Stripe
How customer payments work
PayCal integrates with Stripe Connect to help Business Users accept Tap to Pay, online payments, deposits, invoice payments, payment links and recurring customer payments. A Business User must create or connect an eligible Stripe account and agree to Stripe's own terms, including the Stripe Connected Account Agreement.
Payment processing
Stripe processes payment credentials, identity checks, authorisation, settlement, fraud controls and regulated payment services under its own terms.
Business workflow
PayCal creates the payment request, connects it to the relevant customer, booking or invoice, and records the status returned by Stripe.
- No custody. PayCal does not hold Business User funds and is not a bank, payment institution or merchant of record for the Business User's services.
- Stripe decisions. Stripe controls payment acceptance, verification, payout timing, reserves, risk reviews and account restrictions under its agreements. PayCal cannot guarantee approval or settlement.
- Platform fees. PayCal may charge the platform fee displayed for the Business User's plan. It may be deducted from a transaction through Stripe. The applicable percentage and any minimum or maximum are shown before the feature is used or on the current pricing page.
- Refunds and disputes. The Business User is responsible for its refund policy, customer refunds, chargebacks, disputes, negative balances and related Stripe charges. PayCal may assist with the technical workflow but does not decide the underlying customer dispute.
- Accurate charges. Business Users must charge only authorised, accurate amounts for genuine goods or services and must provide required receipts, descriptions and cancellation information.
- Compliance. Business Users must follow Stripe's restricted-business rules, card-network requirements and all applicable payment, consumer, tax and anti-fraud laws.
Customer service subscriptions
PayCal may let Business Users offer customers weekly, monthly or other recurring service plans through Stripe. The Business User—not PayCal—is the seller and must clearly disclose the service, frequency, recurring price, minimum term, renewal, cancellation process, missed-service treatment and refund policy before a customer subscribes. The Business User must obtain valid authorisation for recurring charges and action cancellation requests promptly.
05 · Business responsibilities
Your business remains your responsibility
PayCal supplies software for managing a service business. It does not supervise the Business User or verify the quality, safety, legality or suitability of the underlying services. Each Business User is responsible for:
- the services it advertises, prices, sells and performs, including descriptions, staff competence, punctuality, quality and customer care;
- licences, registrations, qualifications, insurance, health and safety duties, safeguarding and professional standards applicable to its work;
- its booking, deposit, cancellation, rescheduling, no-show, refund and recurring-payment policies, and presenting them clearly before a customer commits;
- taxes, accounting records, invoices, receipts and reporting obligations;
- ensuring staff, service, availability, location and price information in PayCal is accurate;
- responding to complaints, cancellations, refund requests, chargebacks and disputes from its customers;
- using customer and staff information lawfully, fairly and only where it has an appropriate legal basis;
- obtaining valid marketing, email, SMS, push-notification, photography, form and special-category-data permissions where required; and
- providing its own customer-facing terms, privacy information and legally required business details.
PayCal is not designed as an emergency service, medical-record system, regulated financial-advice platform or substitute for professional compliance advice. Do not rely on it where a delay, outage or data-entry error could by itself create an immediate risk to life or safety.
Customer Users
Customer Users must provide accurate booking and payment information, use only payment methods they are authorised to use, attend or cancel in accordance with the Business User's disclosed policy, and communicate respectfully. Questions about the booked service, its price, delivery, cancellation or refund should be directed to the relevant Business User.
06 · Acceptable use
Use PayCal lawfully and fairly
You must not use, attempt to use, or help another person use the Service to:
- break any law, regulation, court order, third-party right, app-store rule, Stripe requirement or binding industry code;
- commit fraud, misrepresent a business or identity, process sham transactions, test stolen payment credentials, launder money or evade fees;
- send spam, unlawful direct marketing, misleading messages, harassment, threats, hate content or abusive material;
- collect excessive personal information or collect health, biometric, criminal-offence or other sensitive information without a genuine need and lawful basis;
- upload malware or unlawful content, infringe intellectual property, privacy or confidentiality rights, or expose another person to harm;
- probe, bypass or disrupt security, access another account or tenant, overload the Service, scrape it at scale or interfere with its operation;
- reverse engineer, decompile or copy the Service except where applicable law expressly permits and cannot be excluded;
- resell, rent, sublicense or provide PayCal as a service bureau without our written permission; or
- circumvent plan limits, payment controls, platform fees, access restrictions or technical protections.
We may investigate suspected misuse and preserve or disclose relevant information where legally permitted and reasonably necessary to protect users, PayCal or the public.
07 · Data and intellectual property
Your content, our software
Your business content
You retain ownership of information, branding, photographs, files, form content and other material you submit to PayCal (Your Content). You grant PayCal a worldwide, non-exclusive licence to host, copy, transmit, display, adapt and otherwise process Your Content only as reasonably necessary to provide, secure, support and improve the Service, comply with law, and fulfil our agreement with you. This licence ends when the relevant content is deleted from our systems, subject to backups, legal retention and material already lawfully shared at your direction.
You confirm that you have the rights and permissions needed to submit Your Content and allow us to process it. You are responsible for its accuracy and legality. Our handling of personal information is described in the Privacy Policy. Where PayCal processes customer or staff information for a Business User, the Business User is normally the controller and PayCal is its processor.
PayCal intellectual property
PayCal and its licensors own the Service, software, design, interfaces, documentation, branding and all related intellectual-property rights. While these Terms apply, we give you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for its intended purpose. No ownership rights are transferred.
Feedback and aggregated information
If you voluntarily provide product feedback or suggestions, we may use them without restriction or payment, but we will not publicly identify you without permission. We may create and use aggregated or anonymised information that does not identify an individual or business to understand performance, improve PayCal and report broad trends.
Third-party services
PayCal depends on services supplied by Stripe, Apple, Google, communications providers, hosting providers and others. Their services and content may be governed by separate terms. We are responsible for selecting and integrating our providers with reasonable care, but we do not control independent decisions or outages within their services.
08 · Suspension and termination
Closing or restricting an account
What you can do
You may stop using PayCal at any time. Business Users may request account closure by contacting us. Cancel any paid app-store subscription separately through Apple or Google to prevent future renewal. Before closure, export or retain any records you are legally required to keep.
What we can do
We may restrict a feature, suspend access or terminate an account where reasonably necessary because:
- you materially or repeatedly breach these Terms and, where the breach can be remedied, do not remedy it within a reasonable period after notice;
- payment is overdue, an app-store entitlement ends or a connected payment account becomes unavailable;
- continued access creates a credible security, fraud, legal, regulatory or harm risk;
- we are required to do so by law, a regulator, court, app store or essential provider; or
- we discontinue the Service, in which case we will give reasonable notice where practicable.
We may act immediately where delay would expose PayCal, users or others to material harm. Otherwise, we will normally explain the reason and provide a reasonable opportunity to resolve the issue.
What happens afterwards
Access rights end on termination. Provisions that by their nature should continue—including payment obligations, ownership, confidentiality, liability, disputes and legal retention—remain effective. We handle retained and deleted information as described in our Privacy Policy and any applicable business agreement. Account closure does not cancel completed transactions, customer obligations, chargebacks or fees already incurred.
09 · Liability and disputes
Keeping responsibility proportionate
Our commitment
We will provide the Service with reasonable care and skill. If PayCal does not materially conform to these Terms, contact us and give us a reasonable opportunity to investigate and, where appropriate, repair the Service, repeat the affected service or provide another remedy required by law.
Matters outside PayCal's control
We are not responsible for a Business User's underlying services, user-entered information, a user's device or connectivity, or an independent decision by Stripe, an app store or another third party. Neither party is liable for delay or failure caused by events genuinely beyond its reasonable control, although this does not excuse payment obligations already due.
Liability to Business Users
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, PayCal is not liable to a Business User for loss of profit, revenue, business, anticipated savings, goodwill or opportunity, or for indirect or consequential loss. PayCal's maximum total aggregate liability arising from the Service or these Terms is limited to the total subscription and platform fees actually paid by that Business User to PayCal during the 28 days immediately before the event giving rise to the claim. This limit does not reduce any remedy or liability that cannot lawfully be limited.
A Business User will be responsible for reasonable losses, claims and costs suffered by PayCal to the extent directly caused by that Business User's unlawful services, breach of these Terms, infringement by Your Content, or failure to obtain required customer permissions. We will take reasonable steps to reduce avoidable loss and will allow the Business User to participate in the defence of a third-party claim where appropriate.
Customer Users and statutory rights
If you are a Customer User acting as a consumer, nothing in these Terms limits rights or remedies that cannot lawfully be limited under the Consumer Rights Act 2015 or other consumer law. The Business User—not PayCal—is responsible for the booked service and its customer-facing terms. PayCal remains responsible for its own acts and omissions to the extent required by law.
Resolving concerns
Please contact us first so we can try to resolve a concern informally. These Terms and any non-contractual dispute are governed by the law of England and Wales. Business Users agree that the courts of England and Wales have exclusive jurisdiction. Customer Users who are consumers may bring proceedings in any court available to them under mandatory consumer law and retain the protection of mandatory law in the part of the UK where they live.
Changes to these Terms
We may update these Terms to reflect Service, legal, security or commercial changes. We will publish the new version and update the effective date. For a material change affecting existing Business Users, we will provide reasonable advance notice through the app, email or the Service. If you do not agree, you may stop using the Service and cancel a paid plan before the change takes effect. A change required urgently for law or security may take effect sooner.
